OpenAI is demanding Meta hand over any proof of teaming up with Elon Musk and xAI to buy or invest in the ChatGPT-maker.
The move came in a brief filed Thursday as part of Musk’s ongoing lawsuit against OpenAI. OpenAI’s lawyers say they subpoenaed Meta back in June for documents about Meta’s role in Musk’s $97 billion hostile bid for the startup. It’s not clear if Meta has such evidence.
OpenAI claims Musk talked to Meta CEO Mark Zuckerberg about xAI’s bid, including talks on “potential financing arrangements or investments.”
Meta fought back by objecting to the subpoena in July. Now, OpenAI wants a court order to get those documents. They’re also after any Meta records about “actual or potential restructuring or recapitalization of OpenAI” — a key lawsuit issue.
Meta spokesperson Andy Stone pointed TechCrunch to a part of OpenAI’s filing saying neither Meta nor Zuckerberg signed Musk’s letter of intent. Meta declined to say more.
Meanwhile, Meta has pumped big money into its own AI push. This includes hiring OpenAI AI lead Shengjia Zhao to head Meta Superintelligence Labs. Meta also dropped $14 billion on Scale AI and talked to other AI firms about deals.
Meta’s lawyers urge the court to toss OpenAI’s request, claiming Musk and xAI hold the real info. They also say Meta’s internal talks on OpenAI have nothing to do with this case.
